When new legislation passes, PSBA is seen as the leader in analyzing it and helping members make sense of it.

HIPAA compliance critical but complex
School districts need guidance, training

Health Insurance Portability and Accountability Act of 1996

There are significant criminal and civil sanctions for individuals who violate HIPAA. Schools are trying to decide whether these regulations apply to them and if they will need to take steps to comply with the regulatory requirements. And because many school entities engage in some activity that has HIPAA implications, compliance is of utmost importance.

PSBA has received numerous requests from school entities wanting sample policies to help them comply with HIPAA. Unfortunately, HIPAA compliance is far too complex and requires much more than adopting boilerplate policies. Schools will need to work with their solicitor, or an attorney or qualified consultant, to determine what actions are necessary to ensure compliance.

Click here for PSBA's basic HIPAA guidelines (Microsoft Word file), that begin with a recommendation for a HIPAA assessment by a knowledgeable attorney or consultant.

PSBA offers training CD-ROM
Now available is a CD-ROM for school entities that are "health plans" or "providers" under HIPAA to use in training employees involved in covered functions. Presented by PSBA General Counsel Michael I. Levin Esq. and Paul Lalley Esq., the training program includes an audiovisual presentation that is easy to use, interactive and comprehensive.
